The application fee is non-refundable. It is understood that this application is not a rental agreement/lease and that applicant has no right to said property until written rental agreement is duly executed after the approval of the application. Applicant is aware of, agrees to all the covenants and conditions in the proposed rental agreement/lease, and agrees to timely execute said rental agreement/lease after notification of the acceptance of this application. Time is of the essence.
Payment of the credit check fee does not give applicant any right to see or receive credit report data or other information obtained by owner/manager during the verification process.
If the applicant is rejected any reservation fees paid towards the property (excluding the application fee) will be refunded. However if owner/manager has duly accepted this offer to rent, this application is then to be treated as a completed contract to rent/lease the property and the applicant’s attempted revocation shall be deemed a breach of contract. Failure of applicant to timely pay all sums due and execute the rental /lease agreement shall be deemed a breach of contract.
Once the applicant is approved, and a lease agreement has been executed, all funds to secure the property for rental, including but not limited to the application fee, and reservation fees, shall become nonrefundable. These funds will be withheld and considered liquidated damages to offset any losses incurred. Cancellation of a lease agreement by the applicant once the tenant is approved and a lease executed is considered a breach of contract.
Applicants are required to obtain contents insurance (“Renter’s Insurance”) prior to move-in. Policy must name the property owner & NeX-Gen Partners as additional insured/interest.
Applicant represents that the information on all pages of this application is to be true and accurate and understands that owner/manager will rely upon said information when accepting this application whether an independent investigation has been performed or not. Applicant hereby authorizes NeX-Gen Partners, owner/manager and his/hers/its employees and agents to verify said information and make independent investigations in person, by mail, phone, fax or otherwise to determine applicants rental credit, financial and character standing. Applicant hereby releases owner/manager, his/her/its employees and agents, the credit reporting agency, its employees and agents and any and all other firms or persons investigation or supplying information, from any liability whatsoever concerning the release and/or use of said information and further, will defined and hold harmless from any suit or reprisal whatsoever. All holders, public and private, of any such information are hereby authorized to release, without reservation or litigation, any and all such information they have concerning applicant and in doing so, will be acting on applicant’s behalf at applicant request and will be held blameless and without any liability whatsoever. A copy, fax or other reproduction of this authorization shall be as effective as the original.
I understand that this is a routine application to establish credit, character, employment, and rental history. Applicant authorizes the owner to contact past and present landlords, employers, creditors, credit bureau, neighbors, and any other sources deemed necessary to investigate applicant. I also understand that this is NOT an agreement to rent and that all applications must be approved. I authorize verification of references given. I declare that the statements above are true and correct, and I agree that the landlord may terminate my agreement entered into in reliance on any misstatement made above.

Application fees, and deposits towards the rental are to be made in the form of a Cashier’s Money Order or Cash. Under no circumstances a personal check will accepted.
